TERMS AND CONDITIONS
These general terms of sale apply to all orders on the Site. These terms are subject to modification and updates; accordingly, the terms applicable to products orders by customers are those applicable on the date of the order.
1) The Customer :
To be a customer of the Site the customer must be a consumer, of legal age and with full legal capacity.
Customers must, upon placing their first order on the Site, open a customer account and complete an order form containing certain mandatory fields in order for their product order to be processed by My Deva.
The information the customer give to My Deva when opening your customer account or upon any order the customer may place must be complete, accurate and up to date. My Deva may, if applicable, ask the customer to confirm – by any means – your identity and the information given.
On the Site, My Deva collects personal data, such data is required for processing orders and may be communicated, in whole or in part, to our service providers involved in fulfilling the order.
2) Products :
The products offered for sale are those featured on the Site. My Deva makes its best to accurately present and describe the products, subject to technical constraints and in accordance with the highest standards on the market. It is, however, possible that the Site may contain minor errors, which the customer recognize and accept. In the event of any non-compliance of the product delivered with its description on the Site, My Deva agrees to remedy such non-compliance: the customer may either exercise your right of cancellation, or else implement our warranty of merchantability.
If products ordered are no longer available, My Deva will inform the customer by e-mail as promptly as possible and refund the price paid by crediting the credit card.
3) Order :
The acceptance of orders placed on the Site is subject to compliance with the procedure set up by My Deva. This takes the form of a series of succeeding screen pages indicating the steps to be taken by customers to validate their order.
The customer will have the possibility, before final validation of your order, to verify your order details and the total price, and to correct any possible errors, before confirming it and expressing your acceptance.
Verification of the order:
My Deva is entitled, so as to fight against parallel marketing of our products, to refuse any order exceeding the number of authorized products: 10 products, within a limit of a maximum of two identical products ordered.
My Deva are also entitled to refuse any order made by a customer with whom a dispute exists in connection with the payment of a former order as well as any order that is not compliant with these general terms of sale.
In such cases, My Deva will inform the customer by phone or by e-mail. Unless the customer contacts us to correct the error or the non-compliance with these general terms of sale, My Deva reserve the right not to process the order.
Once the customer has validated your order, My Deva will promptly confirm receipt by sending the customer an e-mail to the address provided to us. In that aim, the customer formally accepts the use of e-mail by My Deva to confirm the content of your order.
This confirmation e-mail will include all of the information provided by you, as well as the accepted price and terms of payment with an indication, as the case may be, of any possible difficulties or reservations in respect of the order. For each product, the customer will also receive, upon delivery, written confirmation of the price paid and of the shipping costs applicable to you.
However, for orders placed on the Site, it is recommended that the customer also keep a copy (in electronic format and/or in paper format) of the details in connection with the order (for example, the confirmation e-mail sent by My Deva).
4) Price and paiement :
The prices displayed on the Site are in Euros, shipping excluded. The prices invoiced to customers are those applicable on the date of the order.
My Deva try to guarantee the exactness of the prices of the Site. But an error can occur, and the price of certain Products can be erroneous. If the exact price of a Product is lower than the one indicated in Site, My Deva will charge you the lowest amount and shall send you the Product. If the exact price of a Product is upper to the one indicated in the Site, we shall contact you and shall ask you if you maintain the order with the exact price or if you cancel the order (in which case My Deva will confirm you the cancellation). My Deva will have no obligation to supply a Product with an erroneous price.
My Deva can modify the prices indicated on the Site, at any time and without advance notice. However, the prices so modified will be applicable only to the new orders and not to those who will already have been accepted.
The prices charged to the customer are the ones current in the date of the order.
Payment of the total price of the products and shipping costs are to be made by via Paypal.
Payments by check are not accepted..
It is important to note that for interntational deliveries there might by taxes and duties to pay. These should be paid by the buyer..
5) Delivery :
The delivery is made by My Deva at the delivery address indicated by the customer, being specified that this one has to be the address of residence of the customer or of a person of its choice
The delivery can be made neither in hotels nor in post office boxes.
The Customer will able to follow up the parcel thanks to the tracking number that will be communicated by email as soon as the order is sent.
A signature will be required for the delivery of any parcel.
So that these details are respected, the customer has to make sure to have communicated the exact and complete information concerning the delivery address (such as, in particular: N° of street, building, staircase, access codes, names and\or numbers of intercom, etc.). Inaccurate information risks to delay the delivery, even cancel it.
My Deva take care of orders from Monday to Friday. Generally the orders are treated within 5 working days excluding saturdays and sundays.
As soon as you received the Product, you support all the risks of damage or loss of the Product.
In the presence of a visible abnormality of the parcel (in particular damaged parcel, opened parcel, etc.), the customer must not open the parcel and is invited to bring back the parcel not opened within 5 working days to the post office and to establish a " report of despoliation ".
The opening of the parcel excludes any appeal to The Post office. The customer is also invited to indicate the problem met to MyDeva.com by contacting the customer service via firstname.lastname@example.org
Once the order was confirmed, it will not be possible any more for the Customer to modify the delivery address.
6) Right of cancellation during cooling-off period:
Customers have a right of cancellation, without having to indicate the reasons for such cancellation, within a cooling-off period of fourteen (14) clear days from receipt of the products ordered. If so please send an email to email@example.com
Products must be returned in perfect condition, No refunds will be made for products that are returned incomplete, damaged, altered, deteriorated or soiled as a result of the customer.
Products on sales (reduced price) can not be returned back for reimbursement neither exchange.
Customers are responsible for the cost and the safe return of the product. We recommend that customers keep proof of the return, implying a return by registered letter or by any other means which provides a record of the date of delivery.
Unless the customer has opted for a product exchange (another size and/or another color), My DEVA will refund the full price invoiced (cost of initial shipment included) for the products returned, by crediting the credit card used, no later than thirty days following the date of exercise of the right of cancellation. However, in case of partial exercise of the right of cancellation covering only a portion of an order comprising several products. My DEVA will not be able to make a full refund of the shipping costs initially billed to you.
The exchanges concern only articles of different size or color. If you wish to return your product against another model, it is about a procedure of refund then a new purchase.
My Deva has the right to refuse to sell to anybody that does excesive exchanges. We keep track on that.

7) Force majeure
Mydeva cannot be considered responsible for any delay or for any failure in the execution of our obligations stemming from present General Conditions, if this delay or this failure is attributable in a cause independent from our will.
8) Intellectual Property
Reproduction of part or all of the contents in any form of this Website is prohibited other than for individual use only and may not be recopied and shared with a third party. The permission to recopy by an individual does not allow for incorporation of material or any part of it in any work or publication, whether in hard copy, electronic, or any other form.
